1. Acceptance of Terms

By accessing or using MicroNicheBrowser.com (the “Service”), operated by Amble Media Group LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not access or use the Service. These Terms apply to all visitors, users, and any other individuals who access the Service.

2. Service Description

MicroNicheBrowser.com is a software-as-a-service (SaaS) platform that helps entrepreneurs, founders, and builders discover, validate, and plan profitable micro-niche businesses. The Service aggregates and analyzes publicly available market data, community signals, and search trends to produce scored, ranked niche opportunities along with supporting research including value ladders, competitive analysis, keyword data, and go-to-market playbooks.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice to active subscribers.

3. Account Terms

• You must be at least 18 years of age to create an account and use the Service.
• You must provide accurate, complete, and current information when registering and keep that information up to date.
• You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
• You may register only one account per individual. Creating multiple accounts to circumvent plan limits is prohibited.
• You must notify us immediately at [email protected] of any unauthorized use of your account.

4. Subscription Terms

The Service offers a free tier with limited functionality and paid subscription tiers with expanded access.

• Free Tier: Available at no charge subject to usage limits stated on the pricing page. We may modify free tier limits at any time.
• Paid Tiers: Billed monthly (or annually, where offered) via Stripe. Charges are processed at the start of each billing period.
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
• Refunds: We do not provide refunds or credits for partial subscription months. If you cancel mid-period, you will not be charged for the next period but the current period fee is non-refundable.
• Price Changes: We will provide at least 30 days’ notice before increasing prices for active subscribers.

5. Acceptable Use

You agree not to:

• Scrape, crawl, or systematically extract data from the Service beyond what is expressly permitted by your plan’s API access.
• Reverse engineer, decompile, or attempt to derive the source code of the Service or its underlying algorithms.
• Resell, sublicense, or redistribute data or reports obtained from the Service without our prior written consent.
• Use automated bots, scripts, or tools to access the Service outside of documented API rate limits.
• Circumvent, disable, or otherwise interfere with security-related features of the Service.
• Use the Service to transmit spam, harmful content, or to engage in any activity that violates applicable law.
• Share your account credentials or API keys with third parties not authorized under your subscription plan.

6. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Amble Media Group LLC and its licensors. Our trademarks may not be used in connection with any product or service without the prior written consent of Amble Media Group LLC.

Your data: Any data, content, or information you upload or submit to the Service (“User Content”) belongs to you. You grant us a limited, non-exclusive license to process your User Content solely to provide and improve the Service.

Aggregated data: We may use anonymized, aggregated, and de-identified data derived from usage of the Service to improve algorithms, train models, and publish insights. This aggregated data will never identify you individually.

7. API Usage

Access to our API is available on plans that include API access, as specified on the pricing page.

• Rate limits apply per subscription tier and are documented in our API reference. Exceeding rate limits may result in temporary throttling or suspension of API access.
• API keys are confidential. You must not share, publish, or expose your API keys in public repositories or client-side code.
• Abuse of the API — including attempting to exceed limits through key rotation, credential sharing, or automated circumvention — may result in immediate suspension of your account without refund.
• We reserve the right to modify API endpoints with reasonable advance notice.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices. By using the Service, you consent to data collection and use as described in the Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

• Market data, niche scores, and research outputs are provided for informational purposes only and do not constitute financial, investment, or business advice. You should conduct your own due diligence before making any business decisions.
• We make no guarantee that any niche identified by the Service will be commercially successful. Business outcomes depend on many factors beyond our control.
• Data is sourced from third-party platforms and may be incomplete, delayed, or inaccurate. We do not warrant the accuracy, completeness, or reliability of any third-party data.
• We do not guarantee uninterrupted, secure, or error-free operation of the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AMBLE MEDIA GROUP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, BUSINESS GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

11. Termination

Either party may terminate this agreement at any time.

• By you: Cancel your subscription through account settings at any time. Your account will remain active until the end of the current billing period.
• By us: We may suspend or terminate your account immediately for material violations of these Terms, including but not limited to abuse of the Service, fraudulent activity, or non-payment.
• Data export: Following termination, your data will remain accessible for export for 30 days. After that period, we may delete your data in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days’ notice to active subscribers via email to the address associated with your account. Non-material changes (such as clarifications, typographical corrections, or updated contact information) may be made without advance notice.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service before the changes take effect.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English, and the arbitral award shall be final and binding. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class or representative action.
